Terms of service

1. Purpose

Perksi es un servicio en la nube, titularidad de Liberty Digital Agency LLC, que permite crear y gestionar programas de fidelización digitales.

2. Trial period and subscription

New accounts get a 14-day trial at no cost and with no card required. When it ends, a plan is required to keep using the service. Data is kept throughout that period.

3. Pricing and billing

The prices shown are final: no VAT is added. The service is provided by Liberty Digital Agency LLC, a company established in the United States, and is invoiced as a digital service without Spanish VAT.

Billing is periodic and in advance, handled through Stripe. There is no lock-in: you can cancel at any time and keep access until the end of the period already paid.

4. Customer obligations

• Obtain valid consent from their own customers before signing them up.
• Fulfil their role as data controller towards those end customers.
• Keep their credentials and API keys confidential.
• Not use the service to send unsolicited communications or for unlawful activities.

5. Availability

We work to keep the service continuously available, but interruptions may occur due to maintenance or causes beyond our control. We will give reasonable notice of scheduled downtime.

6. Limitation of liability

The service is provided “as is”. Our liability is limited, at most, to the amount paid by the customer in the three months preceding the event giving rise to it.

7. Cancellation and deletion

You can cancel your subscription from the dashboard. On request, we will delete your data and that of your end customers, except what we must keep by legal obligation.

8. Changes

We may update these terms with reasonable notice by email. If you disagree, you can cancel.

9. Governing law

These terms are governed by the law applicable at the registered office of Liberty Digital Agency LLC, without prejudice to consumers’ rights.
